Terms of Service

These Terms of Service ("Terms") govern your use of The Tip Card mobile application ("App") operated by G Wright Enterprises LLC ("Company," "we," "us," or "our"). By using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms and our . If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.

You may use certain features without an account. Creating an account enables data synchronization across devices. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Data Collection and Sale

By using the App, you acknowledge and consent to our collection of data as described in our . This includes tipping data, venue visit data, service ratings, location data, and device information. You further acknowledge that we may sell or share this data with third parties for commercial purposes. You may opt out of data sale through the App settings.

The App integrates with third-party services including Google Places, Google Sign-In, Apple Sign-In, and Supabase. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. TIP CALCULATIONS ARE PROVIDED AS SUGGESTIONS ONLY AND SHOULD NOT BE RELIED UPON AS FINANCIAL ADVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, G WRIGHT ENTERPRISES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY SHALL NOT EXCEED $100.

You agree to indemnify and hold harmless G Wright Enterprises LLC from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Data retention after termination is governed by our .

13. Governing Law

These Terms are governed by the laws of the State in which G Wright Enterprises LLC is registered, without regard to conflict of law principles.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the App. Continued use after modifications constitutes acceptance of the updated Terms.

15. Account Deletion

You may request deletion of your account and all associated data at any time. Visit our for instructions, or use the "Request Data Deletion" option in the App.
